Please read these Terms of Use carefully. They contain important information about your rights and obligations. The website is brought to you by Lauren’s Personalized Mass Booklets (“we” or “us” or “our” or “the Seller”).
By visiting and/or using the Website, you fully and unconditionally agree to our Privacy Policy and these Terms of Use. If you do not agree to these Terms of Use, please do not visit or use the Website. Any offer provided by us is conditioned upon your acceptance of this Terms of Use agreement. By using this site, you represent that you lawfully consent to U.S. jurisdiction for all purposes on our site as if a resident of the U.S., and have the right, authority and capacity to enter into these Terms of Use Agreement. Please note that Lauren’s Personalized Mass Booklets has the right to modify the Policies and, thus, you should review them periodically.

Your Conduct

Visiting this site: By using this site you agree not to: Modify, adapt, sublicense, translate, sell, reverse engineer, decompile, or disassemble any portion of the Services or the Website; Remove any copyright, trademark, or other proprietary rights notices contained in or displayed on any portion of the Website; “Frame” or “mirror” any portion of the Website, or link to any page from the Website without our prior authorization; Order or purchase Services through the Website if you are not 18 years of age or older, or have the specific permission of a parent or legal guardian.

Sharing Information: By using the Website, you agree not to upload, post, email or otherwise send or transmit any material that: (1) contains viruses, worms, Trojan horses, defects, date bombs, time bombs or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Website; (2) is abusive, illegal, libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights or otherwise objectionable or which may give rise to liability or violate any law; (3) is in violation of a copyright, trademark or other intellectual property or other right of any person; (4) requests personally identifiable information; or (5) contains any advertisement, solicitations, chain letters, pyramid schemes, investment opportunities or other unsolicited commercial communication.

Your Submissions: If you choose to upload or otherwise submit any material through the Website, including without limitation, photographs, images, text, graphics, or files to the Website, by uploading such photographs and files you represent and warrant that: (1) you own or otherwise possess all necessary rights with respect to your Submissions; (2) your Submissions do not and will not infringe, misappropriate, use or disclose without authorization, or otherwise violate any intellectual property or proprietary rights of any third party; and (3) you hereby consent to the use of your likeness, and you acknowledge you have obtained the written consent, release, and/or permission of every identifiable individual who appears in a Submission to use such individual’s likeness, or if any such identifiable individual is under the age of eighteen (18), you have obtained such written consent, release and/or permission from such individual’s parent or guardian. We may request that you submit evidence of your ownership of or right to use your Submissions. If, upon such request, we do not receive information we deem sufficient to evidence such rights, we reserve the right to: suspend the shipping of an order or service relating to such content.

In regards to your uploaded images, files and copyright:
• We agree to simply print your images and content, not own them or use them for anything else. Your images remain your copyright, they belong to you, not us.
• You agree that you are not using any 3rd party images. While we cannot physically stop you from ordering, if we do spot any violations we may cancel your order. So, it is your choice which images you use, but you could be held liable if there any issues.

Age Limitations
You must be 18 to order or purchase Services from this site unless you have the specific permission from a parent or legal guardian.

Order Acceptance, Specifications and Payment

Order Acceptance: All Goods are offered for sale subject to availability and subject to our acceptance of the Order. We reserve the right at any time after receipt of your order to either accept or decline your order for any reason. We reserve the right at any time after the receipt of the order, to supply less than the quantity you ordered of any item. Some circumstances under which we may cancel the order may include but are not limited to 1) defects or damages found at the time of shipping, 2) errors in the product description, quantity and pricing on our website, 3) due to any typographical error, (4) if an item is out of stock or no longer available, (5) we become aware of a product safety concern, or (6) if a product is in violation of copyright or infringement laws or any other legal issue. By placing an order, you accept and agree that the total liability of us under any legal claims whatsoever, shall be limited to the amount of money you have actually paid solely and only for placing the order. If your order is rejected or limited by us, your exclusive and sole remedy is either (a) we will issue a credit to your credit card account in the amount charged for the cancelled portion or the quantity not provided (if your credit card had been charged for the order), (b) we will issue a check for the amount paid by you if payment was received check (if applicable/accepted) or (c) we will not charge your credit card for the cancelled portion of the order of the quantity not provided. It will be in our sole discretion how to refund, refinance, or replace an item with a similar or identical product.

Order Specifications: We have a policy of continuous product development and reserve the right to amend the specifications of any of the products without prior notice. Products supplied may therefore differ as a consequence of multi-standard color systems, notably the international screen based color system of RGB and the print color system used by Lauren’s Personalized Mass Booklets. We endeavor to display and describe as accurately as possible the printed colors of the products which appear on our website, but cannot undertake to give any assurance that the colors of products supplied will exactly match those displayed on your monitor. Product images include digital versions which will not accurately display the resolution of the finished printed product (photos of examples are available upon request).

Price, Payment and Currencies
For each product or service you order from the website, you agree to pay the price applicable for the product or service (including any sales tax, surcharges and any delivery fees for the delivery service you select) as of the time you submitted the order. You undertake that all details provided to us for the purpose of the Order and its delivery will be correct and that sufficient funds or credit facilities are available to cover the full cost of the products ordered. By using a credit or debit card you signify that you are the rightful owner of the card. We shall not be responsible for inappropriate credit card use nor shall we bear the responsibility to verify credit card owner. We will accept cash and personal check only for those occasions we are local to the customer. Payment is expected at the time of order placement for credit card purchases. If paying by cash or check you will be expected to pay at the time of pickup unless other arrangements are agreed upon by both parties.
By ordering from us, you agree to pay for all collection costs, attorneys fees, and court costs incurred in the collection of past due amounts.

Feedback, Draft approvals

Our Highly personalized products often require frequent feedback from you as to content and design before printing. We recommend you check your texts or emails regularly. For time sensitive items, we highly recommend that you include a secondary contact person to make choices if you become unavailable. If we are unable to get in contact with you or the secondary contact person to approve a final draft, then a substantial delay in printing may occur.

Timing and Multiple Orders

We are a small business, designing and producing all booklets, programs and prayer cards ourselves, thus there may be a time when a large group of orders come in for the same date. If this occurs we will accept the orders in a “first come, first serve” fashion. And will notify those ordering later as soon as possible to allow for a change of date/time or a full refund.

Pickup/Delivery

Due to the time sensitive nature of Funeral products we highly recommend you Pickup the order at an agreed upon time. An estimate of pickup time will be provided early on and updated once a final draft is approved. Although we try to complete orders in the estimated timeframe, we reserve the right to change that pickup time for any reason.
For less time sensitive items shipping is an option. The place for delivery of the products will be as shown on the Order and the normal method of delivery (unless specifically agreed otherwise) shall be regular postage. We endeavor to process the Order and manufacture the products within the time period stated for each item. However, because manufacturing time varies by item of Goods, we reserves the right to combine items into one shipping package or to ship items separately. Risk of damage to or loss of the Goods will pass to the Buyer upon delivery to our chosen carrier.

Returns, Refunds, Rights of Cancellation

Once an order is submitted, you may request a cancellation via text or email before work has begun and as long as no digital drafts have yet been created and you will receive a full refund.
You are responsible for reviewing the final drafts and checking spelling of names etc.
Once the final draft is approved and printing has begun, no further changes are possible.
If there is a spelling mistake seen by you after approval, it is up to you to cover the cost of reprints if desired. This includes errors in dates, names etc.
Because of the nature of custom works by Lauren’s Personalized Mass Booklets, Returns of any kind are not accepted.

Limitation of Liability

We will not be liable for short delivery or defective products unless a claim is notified to the us in writing or, where upon reasonable inspection of the products, you have become aware of such defect. The notification must include the Order confirmation number, delivery note number and details of the claim. In the case of a valid claim, we may, in our sole discretion, replace the products(or the part in question) or refund to the Buyer the Price (or an appropriate proportion of the Price). We will have no further liability to the Buyer in respect of the matters referred to in this Section. We will not be liable in any way for loss, damage, costs or expenses (including loss of profit) arising directly or indirectly from any failure or delay in performing any obligation under these terms by reason of any event or circumstance outside the reasonable control of the Seller, including (but not limited to), any strikes, industrial action, failure of power supplies or equipment, government action or Act of God. The liability of the Seller, its agents, employees, subcontractors and suppliers with respect to any and all claims arising out of the performance or non-performance of the Seller’s obligations in connection with the use of the information provided or the rendition of services hereunder, whether based on warranty, contract, negligence, strict liability or otherwise, shall not exceed, in the aggregate, the net purchase price (excluding taxes and freight) for such products or services. In no event shall the liability include damages for loss of profits or revenue; increased cost of purchasing or providing materials, supplies or services; cost of replacement capital; claims of purchaser’s customers; inventory or use charges; or incidental or consequential damages of any nature. This limitation of liability section shall prevail over any conflicting or inconsistent provision contained in any of the documents comprising this Terms of Use. It is up to you to take precautions to ensure that whatever computer equipment and/or software selected for use is free of such items as viruses, worms, Trojan horses and other items of a destructive nature. In no event will we be liable to you or any other party associated with you from any direct, indirect, special or other consequential damages for any use of the massbooklets.com website, or any other hyper linked website, including without limitation, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if we have been expressly advised of the possibility of such damages. THIS SERVICE IS PROVIDED “AS IS” AND “WITH ALL FAULTS”. LAUREN’S PERSONALIZED MASS BOOKLETS AND ITS AFFILIATES HEREBY EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, TITLE, MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

 Intellectual Property

The entire content of the Website, including but not limited to text, graphics and code, is our property. We grant you permission to electronically copy and print portions of the Website solely for your own personal, non-commercial use, provided that you do not change or delete any proprietary notices from downloaded or printed materials.

  • Copyright complaints by third parties
    We respect the intellectual property rights of others and will take appropriate steps to protect the intellectual property rights of third parties if we receive notice in accordance with the Digital Millennium Copyright Act. If you believe your copyright or the copyright of another has been infringed on, please provide us with a written notice containing the following information:
    a physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that you believe has been infringed;
    an identification of the copyrighted work that you claim has been infringed;

Buyer Indemnification of Seller
You agree to indemnify us and our affiliates, employees, agents, representatives and third party service providers, and to defend and hold each of them harmless, from any and all claims and liabilities (including attorneys fees) which may arise from your submissions to massbooklets.com, and/or from your unauthorized use of material obtained through the this website, and/or from your breach of these Terms, or from any other loss or damage of whatever kind suffered by Lauren’s Personalized Mass Booklets caused by your use of our website.

Disputes
Your use of the Website shall be governed by the laws of Massachusetts, without regard to choice of law provisions. Except where prohibited, you agree that any and all disputes, claims and causes of action directly or indirectly arising out of or relating to the Website shall be resolved individually, without resort to any form of class action, and exclusively in the courts of the state of Massachusetts. Any cause of action or claim you may have with respect to the Website must be commenced within one (1) year after the claim or cause of action arises, or it shall be forever barred.
